Normally mperials that kill you aren't actually trying to get you to take the oath. They are just killing you.
Generally speaking you know who is going to oath and who isn't. Nevertheless you still make the token "gesture" of saying "take the oath" when you pk someone. Even good aligned characters who you know cannot take it without losing all their powers.
