1) Maybe the ticket amount was wrong, or maybe the cop's report/brain was wrong. You don't know which, so assume whichever favors the ticket-payer. In most cases, the entire ticket should probably be thrown out.

2) It's the violator's fault for not doing what they were supposed to do. Sending them timely notification is mercy enough.
