Well Ill try asking here as its very hard to get a good answer to this.
In retriving you are only allowed to strike at the captain, unless a tribunal strikes at you. Then you can re-direct. If the tribunal flees and returns you can not attack him again.
Now this also applies if you flee and strike at him again also. Even though he can attack you, without you attacking the captain.
The problem I have here is this. As a hero and you continually fight the tribunal you will die a fair ammount even if you know your way about as there are so many guards even out in the wilds, and your rĂ¥ will make you go into the cities to fight. STAY WITH ME HERE:.. 
Now your con will be lowered quite a bit, its close to impossible to stay alive, now in fighting the outerguardian of the tribunal and say a shaman(worst case) stands there and maledicts you, for instance rot. This wont make him hit me and if I attack him first I get wanted. As I would shurely die of this even if I was prepared to the teeth with +con eq..This for anyone would constitute a greave unfairness in my eyes atleast. As you cannot do any pre-emptive striking without getting wanted.
Id suggest when a player must retrive he can strike anyone that might hinder his retriving as retriving is not just killing the outerguardian.
The player would still not be able to call inn allies from outside his cabal to aid him, as they would get wanted still.

4. Participating in an assault upon the Spire itself is considered a criminal act. Specifically, this means striking at the Tribunal guardians or aiding others to do so is illegal, as is passing beyond the Tribunal outer guardians and into the Spire itself at any time. If you are standing at the entrance to the Spire without attempting to go beyond the guardian or harm members of the Spire, you may be warned to leave by a Magistrate, then you will be flagged if you remain beyond a resonable time required to obey. The only time it is legal to assault Magistrates inside the Spire, or the outer guardian of the Blood Tribunal, is if the Tribunal holds your cabals item of power.
The part in bold is what was changed. You are allowed to strike at the members of the Tribunal and at the Captain without fear of being marked a criminal.
I believe this settles all the issues in this thread.

Also, notice that the part of the law that was changed read The only time an assault on the outer guardian of the Blood Tribunal is legal is if the Tribunal holds your cabals item of power.
No Trib was doing anything wrong before, the way the law was worded allowed for them to flag for being attacked in the cabal no matter the circumstances. As it happens, we agree that you should be able to attack Tribs there as well, so the law was adjusted.

As an outlander...you shouldn't really give two ####s whether you are wanted or not. Because you strive against the laws/rules of society, you do not want to use them to your advantage, you want to destroy them. It just seems silly to complain about being flagged as an outlander...its like saying Yes I want to bring down everything you stand for, but oh god you had better not flag me because well damn that just isn't playing fair! I think Malkhar posted something decent regarding a similar situation, might want to check it out on the graveyard I believe.

It seems to me there is a reason why outlanders are allowed to retrieve without being made wanted. That being game balance (and I say this from someone who plays tribs and never sylvan or outlander).
To take that away by saying the outlander can't strike a trib at the captain is just wrong, imho. Rot is already a fairly sick skill and to allow multiple attempts, to be followed by a manacling and guard beat-down if you attack the guy spamming rot on you is not in the interests of game balance.

The supposition that this whole thread is based upon, is false.
A tribunal can *NOT* flag for a pk that happens at the Captain.
If this was done in the past, either: A) There were other circumstances that were ignored or hidden or forgotten when the incident was reported. or B) There was a mistake.
If spire has sapling (or whatever the new item is), and outlander comes to retrieve, and attacks tribunal *AT THE CAPTAIN*, he should not be marked criminal.
However......
The law states, that if you are standing by the Captain....*AND NOT RETRIEVING* you will be warned to leave, if you do not leave in a reasonable time, you will be flagged.
So....if spire has sapling, and outlander comes to sit at the captain and doesn't attempt a retrieval but sits there for an extended period of time spamming "Murder tribunal"....then it is obvious that the outlander isn't retrieving.......So I can see the outlander being marked for that.
ALSO....
Non-criminal outlander comes to retrieve. Criminal (outlander or otherwise) is with him to help retrieve....and the Outlander is SEEN to assist the criminal avoid capture....killing special guards, healing him, singing to him, shielding him, etc......*THEN* I can see the outlander being marked...but for breaking law #3(aiding a known criminal)...not law #4(an assault on the Spire).
ALSO....
Non-criminal outlander comes to retrieve, perhaps with a friend or two. The Outer guardian falls. the outlander then initiates a strike on a tribunal. I can understand how this can be viewed as an intention to carry on the raid and take the Scales, and I can understand the Outlander getting marked.
I can come up with scenarios ALL DAY where a wanted flag is *CORRECT* but the situation lends itself to easy twisting so that the Outlander can claim...either through ignorance or forgetfullness or confusion or direct obfuscation...that he was marked *JUST* for striking a tribunal that had already struck him, during a retrieval attempt.
So I guess the moral of my post is, beware all claims on how unfair certain Law cabal policies are....because often the policy being declared unfair doesn't even exist.

Ok the things that are important to take note of here is that I am an outlander, and I am retriving alone. There are two fighting at this time. This time two warriors. I also have logs of fighting 5 and the said situation happening. And as an outlander I contest each flag, though I cant complain more than just to create doubt. That would not be within my rp. Now Ill not post their names as that is pointless and char assassinations.
Grurk is not the tribunal in question ither, I had just fought him and attempted to strike at him. Even though he had logged off.*blush*

Then I'd say it was a bad call, and you should not have been made wanted. I could be wrong, but I'd say that is all part of the retrieval, including the strike on trib one instead of the captain, as I believe you are arguing.
Just remember that some tribs are newbs though. Also, if someone messes up and slaps a flag on it is pretty unlikely that others in the cabal will realise there's been a mistake in time to do something about it.
One possible arguement against you is that it looks like you were trying to seal a kill when you could have ignored trib1 and finished off the Captain. However, I'd still be inclined to describe that as a retrieval from start to finish,

Now Ill say I spoke to someone, this was not within my rp about this incident. Lets say someone in charge. And they said the warrant was fair. And this is not a newb...
Ill not assassinate any chars because of this, its rather a circumstance Id like to have made clear in the laws.
Now to the one that thinks that outlanders care nothing for the law, you are partially correct. Now they are all different. Some are oppertunitists. Now using the laws to manage things is well within their rp, now contesting a flag and keeping at it for a long time is not.
Now in this incident, not the first, I was so frustrated that I did some of this, and hence I deleted my char, this was not the only reason, but part of it.
Ill rest my case here, so that none of the involved gets invaulentary routed out. All I wanted was an imms oppinion about the situation and it made clear. As the situation with a spellcaster maledicting you, and your not able to do anything is quite horrible... And its pretty onesided that they can strike you and you cannot strike them, Id rather see the space where the captain stands as a warzone. where there are no laws when they hold another cabals item of power.

You are not the authority on Tribunal that you seem to think you are, and it's beginning to get irritating.
These flags are not isolated incidents. The Tribunal who make them are not punished. Tribunal who attack non-wanted retrievers with special guards are not punished. I've seen even further grey area discretion by the cabal leaders. This leads me to conclude that there is a grey area in the Policy that allows Tribunal to twist the laws and warrant in cases not explicitly called for in the laws. Imm encouragement of using that grey area amounts to Policy.
The fact that you keep on lying and claiming these actions don't happen all the time, disguising it behind "It's not Policy!" is getting to be frustrating and misleading. Misleading because it lures people into actions that you insist will not result in a warrant, and yet they do.. consistently.

That's mutual. As a non-outlander, I am in the happy position of being able to clarify each thing I want to with the Provost at any time I want. So I think I do have a pretty good idea.

Wrong. I have seen tribunals punished for this.

That's a different issue.

Yes, and I have too. Tribs do have a fair bit of discretion. However, there is a limit as to how far they are allowed to exercise it, because of game balance. Sometimes something can be justified once, is raised with the Provost, and he clarifies the extent of their discretion for the future. That's the stage where things like this get ruled out. Not by the Justiciar. Not by the Vindicator. Not by the Provincials. It is the Provost (possibly with imm input) who ultimately determines how much discretion Magistrates have.

Yes and no. For all the whining about Grurk and the Palace, you cannot warrant for attacks on the Empress. I believe it was done once because there are separate laws written in that city. Then the Provost made it clear that it was never to be done again.

Nope. Policy is set by the Provost. Obviously the Provost can't anticipate everything in advance, but if you ask him to clarify, to you and his Magistrates, how much discretion they have in certain situations, he usually will. It is possible he will allow an existing flag to stand as it was not ruled out at the time, but rule it out for future cases.

I'm not lying. It is not Policy. If it was Policy, all tribs would have to do it, and they don't. Capische?

Did I insist at any stage it would not? Go back and re-read my posts. At every stage I've either said it needs to be clarified with a senior trib (read provost, not justiciar, not vindicator), and that IF it happened as displayed, it looks wrong to me.

I could name at least 4 or 5 tribs who wouldn't have flagged in that situation. If you spoke to the Provost and asked him to clarify the issue to all, it could be clear to both you and the magistrates. You haven't done that.

You totally misinterpreted my post there anyway. I was arguing that it is wrong for reasons of game balance. If you recall, I also argued that it would be wrong to let tribs manacle raiders, before it was actually stated that retrievers were allowed to retrieve without being made wanted.
So despite my affiliation with tribs, these posts have being saying that it shouldn't be allowed because of game balance. It would make things too easy for tribs.
My comments on the flags are a separate thing. At no stage have I said that you won't get warranted for it.

I said using special guards to attack non-criminal retrievers is Policy created by mortal Tribunals, even though it is not explicitly written in the Laws.
It's called an example. An illustration. An analogy. People use these things to demonstrate their point.
