I've died exactly three mob deaths (so far) and my CON is still at max. And I haven't trained it back up to max.
Let me know if you need a character name and I'll respond with it.

It was me. First death was in the White Dragon Lair. Second death was in the Kuo-Toa Lair. Third death was in some part of the Underdark that's apparently area explore.
